These Terms and Conditions ("Terms") govern the Eko SMS program ("Eko" or "the Service") operated by LAB90 LLC, a Georgia limited liability company ("we," "us," "our"). By opting in to receive Eko messages, you agree to these Terms and to our Privacy Policy.

1. Program description

Eko is a hyperlocal community SMS service. Subscribers receive one curated SMS per day featuring a short headline and a link to a daily landing page covering local news, civic alerts, school sports, community events, and deals from businesses in Coweta and Fayette counties, Georgia. At signup, you choose up to two local areas (for example, Newnan, Peachtree City, Sharpsburg, Senoia, Tyrone, or Fayetteville). The messages you receive are filtered to those areas.

2. Message frequency

You will receive up to one (1) Eko SMS message per day. Eko enforces this cap as a core feature of the Service. You will not receive more than one promotional or content SMS per day from Eko, except for the following operational messages, which do not count toward the daily cap:

The Eko service is free. However, message and data rates may apply to messages you send to or receive from Eko, depending on your mobile plan and carrier. Eko is not responsible for any such charges. If you have questions about your plan, contact your wireless carrier.

4. How to opt in

You opt in to Eko in either of these ways:

  1. On the web at https://eko.day, by entering your mobile phone number, selecting up to two local areas, and checking the (unchecked-by-default) consent box that confirms you agree to receive Eko SMS messages and have read these Terms and the Privacy Policy. After you submit, we send you a 6-digit verification code by SMS; you confirm by entering that code on the next screen. Your subscription becomes active only after this confirmation step.
  2. By text, by sending one of the following keywords to the Eko number: JOIN, START, SUBSCRIBE, YES, or EKO. After you text in, we send a confirmation message with a link to these Terms; your subscription becomes active when you reply to confirm.

Consent to receive Eko SMS is not a condition of any purchase.

5. How to opt out

To stop receiving Eko messages at any time, reply STOP to any Eko SMS. You will receive one final confirmation message and then no further messages from that campaign. Standard message and data rates may apply to the STOP message itself. The following keywords also stop service: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT.

If you change your mind later, you can opt back in using either method described in Section 4.

6. How to get help

For help, reply HELP to any Eko SMS. You will receive a reply that includes how to contact support and how to opt out. You can also email support@eko.day at any time.

7. Supported carriers

Eko works on all major U.S. carriers, including AT&T, Verizon Wireless, T-Mobile, and U.S. Cellular, as well as most regional carriers. Carriers are not liable for delayed or undelivered messages. Service availability is subject to your carrier's network coverage and policies.

8. Eligibility

You must be at least 16 years old and a resident of the United States to use Eko. By opting in, you confirm that you are authorized to receive SMS messages on the phone number you provide and that the number is registered to you.

If your mobile number changes, please opt out from your old number and re-subscribe from your new one to avoid messages going to a number you no longer control.

9. Content

Eko's content is curated by LAB90 LLC's editorial team and may include information about local events, deals, civic alerts, sports, and community happenings. Information is gathered from public sources, official notices, and businesses that have agreed to be featured. We work to be accurate, but Eko's content is provided "as is" and without warranties of any kind. Verify time-sensitive details (for example, store hours, prices, school schedules) directly with the business or organization before acting on them.

We do not endorse any business or organization featured in Eko unless explicitly stated. Inclusion in a "Today in [town]" roundup is not an endorsement.

10. Acceptable use

When you use Eko, you agree not to:

We may suspend or terminate any subscription that violates these Terms, without notice.

11. Privacy

Your privacy matters. See our Privacy Policy for details on what we collect, how we use it, and your rights. In particular: mobile information (including your phone number, opt-in status, and consent) is never shared with third parties or affiliates for marketing or promotional purposes.

12. Disclaimers and limitation of liability

To the maximum extent permitted by law, Eko and LAB90 LLC, our officers, members, employees, and service providers, are not liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of data, loss of revenue, or loss of goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of these Terms is limited to one hundred dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top and, for material changes, notify subscribers by SMS or by posting a banner on eko.day for at least 14 days before the change takes effect. Continued use of the Service after that period constitutes acceptance of the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Coweta County, Georgia, and you consent to the personal jurisdiction of those courts.

15. Entire agreement and severability

These Terms, together with the Privacy Policy, are the entire agreement between you and LAB90 LLC regarding the Eko Service and supersede any prior agreements. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full effect.
